Can I get arrested for carrying a fake sword or gun, for Halloween?
There have been some kids who were arrested last year for carrying Nerf guns in a campus-wide game: Humans vs Zombies, in which they would shoot the zombies before the zombie could touch them. It isn’t the first time I have heard of these ridiculous happenings. I don’t want to get arrested for carrying a sword and pistol replicas for Halloween. I would leave them at home, but they just make the costume. They look real, except the sword is duller than a butter knife and padlocked to the scabbard, and the gun’s barrel is only hallow for an inch or so (plus a REAL flintlock couldn’t hit the broad side of a barn much less kill anything). Anyone have any expereinces or quotations from the law? (I live in Ohio if that help answer the question).
If you’re wearing them as “costume pieces” and aren’t brandishing them in any way (i.e., taken them out and pointing them at people) you shouldn’t have any problems simply wearing them around.
You may get *some* harassment, especially if you do anything illegal while wearing said “costume pieces” — (I got pulled over once and the officer noticed my swords / knives in the passenger seat next to me … these were legitimate “weapons” in my case … but I explained that they were costume props … after searching me & my car – running my ID for warrents, etc., etc. I realized my mistake and moved them to the trunk after they let me go before driving off)
